Langwith and Whaley Thorns PSPO 2019


Bolsover District Council is reviewing the need for a Public Spaces Protection Order (PSPO) in Langwith and Whaley Thorns. We are therefore consulting all community representatives/ interested parties. A PSPO is a provision, created by the Anti-Social Behaviour, Crime and Policing Act 2014, which is intended to deal with persistent and unreasonable conduct by individuals in a public place which is detrimental to the local community’s quality of life. The aim is to stop individuals or groups committing anti-social behaviour in public spaces. They are designed to ensure the law-abiding majority can use and enjoy public spaces, safe from anti-social behaviour. Enforcement can be undertaken by council officers, police officers and PCSOs. In 2015 the Council made a PSPO which was successful in tackling anti-social behaviour in Langwith. We have worked with the Police and believe that there is a need for the order to be reviewed. Based on the latest reports of anti-social behaviour witnessed and reported to the police, we are removing a prohibition which is no longer needed, and creating a direction to leave requirement. The proposal is that there will be a new Order which will introduce restrictions for the use of a defined area.                               

Why are we Consulting

Before you answer the consultation questions, we advise that you view the full order (and map) which can be found below.

If you have any comments or objections to the above we would appreciate your feedback by/before Monday 25th November 2019.  A decision as to whether to issue an Order with new terms will be made after the consultation ends. The PSPO restrictions are being proposed on the area highlighted on the attached map:

a. No person shall have unsealed vessels containing alcohol in their possession

b. No person shall urinate, defecate or spit in any public place

c. No person shall dispose of any  litter other than in the bins provided

d. No persons shall make excessive noise which is likely to cause nuisance or Anti-social behaviour

e. It shall be an offence if a person fails to comply immediately with a direction from a constable or Authorised Person to move on from land within the Restricted Area.
